It's in the "member galleries" section... meaning it hasn't been uploaded as fanart. The user hasn't claimed it as their own at all. Generally speaking, this section has no use or rules at all, it's hard to enforce any when it's use isn't stated. Users upload random undersize, useless things they didn't make themselves all the time.

The section is difficult in that
1) it is not independantly browseable
2) everything there is stolen, misplaced or being used as a spot to store an image being used/linked to elsewhere on the site
