Thread: Is 'Sexting' protected by the 1st Amendment

I think it's completely wrong. Even if it's to one of your best friends, it's still subject to many things. This includes rumors and yes, sending to other people. I mean, so long as the original sender wouldn't find, they would think they'd be okay? I doubt that would be the case anyways. Things like this spread like wildfire, I know this firsthand. Something like this happened to my school a couple years back and within 2 days, nearly everyone was talking about it and nearly EVERYONE had a picture by the end of the week. Even me, and I only give my number out to my closest friends. It's really...kinda sickening. So, my thought is that, while I do believe people are able to express themselves...well...this takes it a little too far. I can't honestly say it should be blocked, but rather...cracked down on more? Don't phone companies have access to this type of thing? (Disregard E-mail.) It's just...ugh.

Yes, they do, but they are required under federal law to keep it confidential, and those caught violating that law face stiff fines in the hundreds of thousands of dollars for the perpetrator and company, as well as possible jail time.

I think it does no real harm and hey if you want to take pictures of yourselves let them. As far as thoughts on porn I say legalise it all. To address Lenmiyata directly, you cab see videos of death and people committing crimes on news TV specials and the net. Hard for me to believe people having sex is worse than that. I say remove the underage porn restrictions. Even now I know a grandmother talking to the police trying to get them to investigate who took her daughters virginity. The problem is the supposed wronged party wants no part of it. It just waste time. Besides legalising all pornography will mean a more stable element controls it and people can start getting paid.

That's a tough question to answer...

I would suppose it depends on where the image is goin'. If it's a 15 year old girl sending nude photos to a 40 year old man, then something's not right there. But if that girl is sending it to her boyfriend (who is of the same age bracket), then I guess nothing's wrong. I dunno. It's like calling an apple a grape. You can say that it's "free speech", or you can say it's "kiddie porn" and no matter how you look at it, someone's gonna disagree.

I personally think that if you're not the recipient of the text in question, why even bother worrying about it?

Sexting is wrong. Most people sexting are under 18, so it is considered Kiddie porn. Also sexting makes it easier to child predators to get what the want, nude children images.
