Therefore by the courts own standards of reasonable proof your school has justifiable cause. As I said before. "Don't like it? Get angry at the students that are giving them "reason". If drugs are found at school and they have a valid reason to the randum searches then they are going to do it. If there is no drugs then they will not do it. When it comes to persanle proprty is when you need a warrent and concent forms and that is where the 4th amendment comes into play. The students dont own the school, they dont own the lockers, they dont own the books. Pluss, if they made an anouncment that there will be a drug search to the students, those who have the drugs will hide them off campuse or not bring it that day. Because when they search is over they bring the drugs back the next day and nothing has been accomplished. Or in the case of a test, the students wont show up. They are trying to keep every one safe. (This is not directed to any one persanly) So I say please stop complaining like a little child whos parents had stopped you or some one else from playing with fire. |

I grew up playing sports and each year we had to take a physical and give a “sample”, it wasn’t a big deal to me and if it keeps children off the field that are a potential danger to not only themselves but the others as well, then good...not to mention remove cheaters. As far as random sampling children in schools…I see no problems, Heck I know when I was growing up I would have loved for something to be done about those children who were high/stoned and in the same class as me. Not because I wanted them out but I happen to have cared enough about my fellow class mates to want to get them help, maybe some of them that died from Alcohol or drug related incidences would still be alive (For the record there were 22 of my friends which died before they were 21 because of various things, most stemmed from drugs or alcohol of some sort). And a drug problem is a bad thing for ALL children or really anyone for that matter. Just my opinion.

Privacy is a HUGE factor when speaking of school district activities. Like the whole Facebook ordeal. Those students were suspended for "drinking" but it wasn't on school grounds, nor was it during school hours. There's a limit to what you can do to students regarding their conduct. Outside the school, teachers have no control (which is why the incident is so controversial). No ON school grounds, you can't give a drug test to a student unless they've given you a good reason too. IE: Coming to class high, a mass of students speaking of your drug habits/dealing, dropping "evidence", etc... Word of mouth can be a good enough reason to search a student, but definitely not to give one a UA. I've got a brother who had to go through the same thing just a week or two ago. When I was his age, I had to put up with the same sh*t. He got caught with a marijuana pipe at school (Yeah, I'm dissapointed) AND was accused of dealing drugs (not weed) in school. So, when I had to take him back to school and speak with his principal, I asked him, "What gave you the right to search my little brother? I understand you're doin' your job, and I appreciate it, but where was the probable cause? Did you search other students as well?" I found out that even though there were other students suspect, my brother was the only one searched. His mom and I thought it was pretty F'ed up, so we bitched to the school, they agreed to let him back, but I had to bring him there. Come to find out that they had caught the student who had blamed him for dealing and suspended THAT student for possesion during my bro's suspension. AND they're trying to charge him with distribution. (I bet my brother's happy). There are things that the schools can and can't do. The problem is that nobody but superintendents know what those things are. | |

In my country is not yet a "requirement" but it is getting there and with that the schools are being "cleanned" bits by bits from drugs. It is really sad to see kids getting drugs so early and IN THE SCHOOL!!! so I am happy that the govt is showing its concern for the students and is doing something.

Diamond in the Rough | Re: Should Mandatory Drug Tests For Students Be Used? Doesn't matter to me, I don't do drugs, so it wouldn't bother me all that much. But, That doesn't take away the fact that we have certain rights that shouldn't be violated, at least until we are 18 or older. |
