    well many people refuse to film people having sex without a condom for risk of a baby or a disease, and the problem is that no matter how good the condom is, the sensation of a bare.....um.....rod... wont be beaten. and for example, africans cannot afford condoms and pay prostitutes to have sex and leave without any protection, there for risking the disease of aids.

    You assume all that stuff is not already happening. Human Trafficking is one of the largest undiscussed problem right now. Guess where they go? The sex trade, at all levels.

    Yes, because the porn industry is full of family people just trying to make a living. Honestly, isn't that a huge assumption? How do you know that? And just out of curiosity even if somehow it is true how does that mean they are not "defiling" themselves?

    Last I heard no one was in counciling because their wife watched too many soap opera's. But if you can find me proof that it has broken up a significantly large number of marriages I would be ready to support it.

    What you are describing isn't protected by the First Amendment. In fact, what you are describing is illegal under privacy laws. The person who was recorded without their consent can sue for damages against the person who recorded it and against the person who distributed it (if they are 2 separate people).

    Although it would be humiliating for them because now the "cat's out of the bag" so-to-speak and you can't undue the images being broadcast, the lesson learned here would be to take great caution with whom you engage with sexually.

    That kind of activity is "banned" in a sense that it is illegal and their are ways to claim damages through our courts.

    Banning professional pornography - where hired actors/actresses perform in a professional studio with unionized film crew, accredited editing personnel, distributed by large professional distribution companies, marketed by professional marketing companies, etc etc etc - is in direct conflict with the First Amendment's guarantee of freedom of expression.

    I believe that is currently in debate in the courts. Also that sort of thing varies from country to country.

    Please show me where there is anything in the courts closely resembling a ruling on banning pornography - of the professional "mainstream" variety we are talking about. (I think it's safe to assume that we are all in agreeance that "fringe" porno - like animals, children, unwilling performers, etc - is not what we are talking about.)

    The infamous line of "I can't define it, but I know it when I see it" just doesn't have the backbone needed to hold up to legal scrutiny.

    Also, I was assuming this discussion was about banning pornography in America. Forgive me for assuming this. It would seem to be a far too complex issue if we had to take into consideration the laws of EVERY country in the world in this debate. So for simplicity sake, can you agree that we are discussing America?

    OK, then lets ban credit cards. I know plenty of marriages that have been ruined because of women spending too much money haphazardly.
